General Terms and Conditions of Sale

1. INTRODUCTION

These Terms of Use (the “General Terms”) govern your use of our website www.aouid.ma and our mobile application “AOUID” available for iPhone and Android devices. The Website and the Application are collectively referred to as the “Platform.”

Please read these Terms of Use carefully before using our services. If you do not accept these terms, you may not use the Platform’s services, and we ask that you uninstall the application. By installing, downloading, or simply using the Platform, you enter into a contract with AOUID and agree to the Terms of Use and other AOUID policies (including, but not limited to, the cancellation and refund policy, privacy policy, etc.) as published on the Platform from time to time. These policies take effect on the date you download, install, or use the Services and create a legally binding agreement for you to comply with.

The Platform may be used by:
(i) Individuals who are at least 18 years old.
(ii) Legal entities, such as companies. In such cases, these Terms will be subject to the specific regulations of each country as outlined herein.


2. USE OF THE PLATFORM AND SERVICES

All commercial/contractual terms are offered and agreed upon solely between Buyers and Merchants. These terms include, but are not limited to, pricing, taxes, shipping fees, payment methods, payment terms, delivery dates and modes, product and service warranties, and after-sales services.

AOUID does not control, determine, advise, or participate in any way in the offering or acceptance of these commercial terms between Buyers and Merchants. However, AOUID may offer assistance services to Merchants, such as order fulfillment support, payment collection, customer service, and other services under separate agreements with Merchants.

AOUID is not responsible for any non-performance or breach of contract between Buyers and Merchants on the Platform. AOUID does not guarantee and cannot guarantee that Buyers and/or Merchants will complete any transactions conducted on the Platform. Furthermore, AOUID is not responsible for unsatisfactory services, service failures, or any damages or delays resulting from stock shortages or unavailability of products.

AOUID operates as an e-commerce platform and serves solely as a facilitator. At no point in a transaction between a Buyer and a Merchant does AOUID take possession of any products or services offered by the Merchant. AOUID does not hold any rights, titles, or interests in the products and has no obligations or liabilities regarding any agreements between Buyers and Merchants.

You acknowledge and agree that AOUID is not responsible for:

  • The quality of goods provided by stores or restaurants, including whether food orders meet your needs or expectations.

  • Any loss, damage, or dissatisfaction caused by the Merchant’s goods.

  • The availability or unavailability of certain menu items.

  • Incorrect orders delivered by the Merchant.

  • Changes, cancellations, or unavailability of menu details and pricing as provided by Merchants.

  • The accuracy of food images on the Platform, as they are for representation purposes only and may not match the actual order.

2.1 Fraud and Account Freezing

If AOUID detects signs of misuse, inappropriate, or fraudulent activity on an AOUID account, it may automatically and without prior notice deactivate the associated subscription and, at any time, disable the user’s account. AOUID reserves the right to take legal action depending on the severity of the case. Additionally, AOUID may cancel service and subscriptions at its sole discretion with prior notice to affected users.


3. PERSONAL INFORMATION YOU PROVIDE

To use our services, you must create an account on our Platform. During registration, we will request personally identifiable information such as your name, phone number, and email address. We may also collect demographic information like your postal code and allow you to submit additional details as part of your profile.

We encourage you to carefully consider the information you share and protect your sensitive data. You may review and update your profile at any time.

Please note that delivery times provided at the time of order confirmation are estimates and may vary. We are not responsible for delays caused by the seller/merchant in processing the order or other unforeseen circumstances. Your order will only be delivered to the address provided at the time of purchase.


4. ONLINE SALES TERMS

The following online sales terms govern all transactions made through the Platform. Any transaction made via the Platform constitutes unconditional and irrevocable acceptance of these terms by the customer.

4.1 Purpose

These terms define the rights and obligations of the parties involved in online sales conducted through the AOUID Platform.

4.2 Sales Process

The customer logs into the AOUID Platform, selects the items they wish to purchase, clicks the "Pay" button, and chooses a payment method—cash, wallet, or card. If paying by card, the customer is redirected to the secure online payment gateway of the Interbank Monetary Center, where they enter payment details and confirm the transaction.

4.3 Payment Methods

Customers can choose to pay in cash or via a bank card:

4.3.1 Cash Payment
If paying in cash, the customer hands the money to the delivery person upon order arrival.

4.3.2 Bank Card Payment
If paying by card, the customer must enter their card details on the secure payment page. Once the transaction is accepted by the bank, the amount is debited on the next business day after confirmation. Online payments are secured by the Interbank Monetary Center.

Customers must ensure they have sufficient funds when selecting a payment method. In the case of card payments, banking agreements between the customer, their issuing bank, and AOUID’s banking partners apply.

4.4 Pricing

Prices displayed in the catalog are in Moroccan dirhams (MAD) excluding taxes and are valid at the time of customer consultation. The applicable VAT is calculated on the order summary. Any tax rate changes will automatically affect product prices.

4.5 Delivery
  • Delivery fees are paid by the buyer.

  • Prices are inclusive of tax and are calculated based on distance (km).

  • Transport costs are shown on the electronic invoice sent via email.

4.6 Right of Withdrawal

From the date of order delivery, customers have 7 days to request a full refund. Return shipping costs are the customer’s responsibility. Only goods in perfect resale condition, complete, and in original unopened packaging are eligible for a refund.

For health and hygiene reasons, certain product categories are non-returnable unless the wrong item was received, or the item was defective, damaged, or counterfeit.

Refunds are credited to the customer’s AOUID wallet, excluding delivery fees.

4.7 Data Confidentiality

Customer payment information is required to process transactions and is handled confidentially. Customers can review and update their personal data via the AOUID Platform.

4.8 Proof of Payment

Payment records stored on the Interbank Monetary Center’s online platform on behalf of AOUID serve as proof of online transactions made by the customer.

4.9 Force Majeure

AOUID is only obligated to fulfill its commitments as long as no force majeure event disrupts its operations.
